Revised I-9 Will Give Employers a New Option for Employment Eligibility Verification

On July 21, 2023, the Department of Homeland Security (DHS) announced that effective August 1, 2023, employers who participate in E-Verify (a free web-based system operated by DHS in partnership with the Social Security Administration) have the option to conduct employee verification electronically and with a live video call interaction. Accordingly, a revised I-9 will be published by USCIS on August 1, 2023. This is a welcome and timely announcement for employers impacted by the impending end, on July 31, 2023, of the previous COVID-19 Form I-9 flexibilities which allowed employers to remotely inspect their employees’ identity and work authorization documents. Note that employers who do not participate in E-Verify, have until August 30, 2023, to perform all required physical examination of identity and employment authorization documents for those individuals hired on or after March 20, 2020, and who have received only a virtual or remote examination under the COVID-19 temporary flexibilities.
